A woman has won her bid to overturn a conviction for allowing her boyfriend to murder her 13-month-old daughter.
Andrea Bone, 23, was jailed for three years in 2002 after failing to stop Sandy McClure murdering Carla-Nicole at their home in Aberdeenshire.
The judges accepted legal arguments that Ms Bone was intimidated by her violent boyfriend.
She also suffered from intellectual and personality difficulties which made it hard for her to intervene, it was said.
Ms Bone had been freed pending the outcome of her appeal.
McClure, 30, was sentenced to life for murder with a recommendation that he serve a minimum of 13 years.
He had swung Carla-Nicole by the legs and hit her against a wall of the secluded cottage near Huntly that the couple shared.
The High Court in Stonehaven heard that Ms Bone sat smoking and sipping coffee as the little girl was violently beaten.
