Dershowitz on the killing of a Hamas operative....

And, what if the Israelis had killed him???
The Goldstone report suggests that Israel cannot lawfully fight Hamas rockets by wholesale air attacks. Richard Goldstone, in his interviews, has suggested that Israel should protect itself from these unlawful attacks by more proportionate retail measures, such as commando raids and targeted killing of terrorists engaged in the firing of rockets. Well, there could be no better example of a proportionate, retail and focused attack on a combatant who was deeply involved in the rocket attacks on Israel, than the killing of Mahmoud al-Mabhouh. Not only was Mabhouh the commander in charge of Hamas’ unlawful military actions at the time of his death, he was also personally responsible for the kidnapping and coldblooded murder of two Israeli soldiers several years earlier.

Obviously it would have been better if he could have been captured and subjected to judicial justice. But it was impossible to capture him, especially when he was in Dubai. If Israel was responsible for the killing, it had only two options: to let him go on his way and continue to endanger Israeli civilian lives by transferring unlawful anti-personnel weapons from Iran to Gaza, or to kill him. There was no third alternative. Given those two options, killing seems like the least tragic choice available.

I leave to others, more expert in these matters, whether if Israel ordered the killing, it was strategically the right thing, or whether they carried it off in an intelligent manner. But as to the legal and moral right to end the threat posed by this mass murderer, the least bad alternative would seem to be his extrajudicial killing.

G&R since you persist in defending assination and refuse to acknowledge Israel's terrorist origins, please comment on today's Ottawa Sun:

Everyone agrees, including the terrorist himself, that he is better off dead. At least we can all agree on that.

Whats your point?
Why are you trying to defend a terrorist who is responsible for murders and armament to a terrorist organization?
There was no collateral damage except for some forged passports.
If the killing of archi terrorist was to terrorize Hamas then they did an excellent job.
If you support a Palestinian state then you should support his liquidation.

Guest 4096 - why are you defending an otherwise admirable state which suffers from the illusion that it is above the law.

I ask you - as I have G&W = do the ends justify the means?

Many non-anti-semites do not feel they do. Has Israel ever apologized for killing Canadians, or using Canadian passports...?

"..An Israeli bombardment killed four United Nations Observers, despite multiple warnings by UN peacekeeper. The peacekeepers at the post said the area within a kilometer of the post was hit with precision munitions, including 17 bombs and 12 artillery shells, four of which directly hit the UN observation post. The fatal strike with a "precision-guided weapon" according to UN military personnel hit the post at about 7.20pm. The victims were Austrian, Canadian, Chinese and Finnish UN-observers."

Israel is accountable to no one -- that is FASCISM, my friend.

I assume you have the same resentment toward american , british and other nato forces in iraq and afghanistan or you hold only the israelis to this high moral standard.
Its clear to me you have no idea what the meaning of the word fascist is. Why cant you support a palestinian state and oppose a terrorist organisation such as hamas which toppled the pa in gaza?
